Terms of Service

3.1 What does Viral offer?

Viral is a growth prediction tool for content creators using ApisDom's Chronos-2 API. The Service includes:

• ✓Growth predictions based on historical data you provide
• ✓Analysis of multiple metrics (subscribers, views, engagement)
• ✓Support for multiple platforms (YouTube, Instagram, TikTok, Twitch, etc.)
• ✓Credit system (buy once, use whenever you want)
• ✓Prediction history (registered users)
• ✓Data export

3.2 What does Viral NOT include?

• ✗Result guarantees: Predictions are statistical estimates based on AI models and do not constitute guarantees of future performance
• ✗Professional advice: Viral does not replace expert advice in marketing, finance, or content strategy
• ✗Unlimited access: The Service works through a credit system

4.1 Free Predictions

• •2 free predictions per registered account
• •Try the engine without registration, unlock full results when you sign up
• •No credit card required

• •1 credit = 1 unlocked prediction
• ✓Credits DO NOT expire
• !Credits are NOT transferable between accounts
• !Credits are NOT refundable (except for exceptions indicated in section 5)

5.1 General Rule

Credits are digital products delivered instantly. As a general rule, no refunds are made because they are added to your account immediately, have no expiration date, and a free trial period (2 predictions) is offered.

5.2 Exceptions

• ✓Technical error preventing credit use (14 days to request)
• ✓Double charge due to Stripe error (automatic refund)
• ✓Serious service quality issues (case-by-case evaluation within 7 days)

5.3 Request Procedure

1. Send email to soporte-viral@apisdom.com
2. Subject: "Refund Request - [Stripe Transaction ID]"
3. Include: detailed reason, screenshots, relevant information
4. Response time: 5 business days
5. If approved: refund processed in 5-10 days

6.1 Permitted Use

• ✓Use the Service to analyze your own content
• ✓Use the Service to analyze public third-party content for research or benchmarking
• ✓Share prediction results (mentioning Viral as source)

6.2 Prohibited Use

The following is expressly prohibited:

• ✗Scraping, crawling, or reverse engineering the Service
• ✗Using bots, scripts, or automation to generate mass predictions
• ✗Sharing your account with third parties or allowing unauthorized access
• ✗Reselling predictions or results without prior authorization
• ✗Using the Service for illegal activities, spam, or fraud
• ✗Making misleading claims about predictions (presenting them as guarantees)
• ✗Attempting to circumvent the credit or free trial system
• ✗Intentionally overloading servers or performing denial of service attacks

Violation of these rules will result in suspension or cancellation of your account without refund of unused credits.

7.3 License of Use

We grant you a personal, non-exclusive, non-transferable, and revocable license to use Viral in accordance with these Terms of Service.

8.1 Nature of Predictions

Predictions generated by Viral are statistical estimates based on:

• •Historical data you provide
• •Artificial intelligence models (Chronos-2)
• •Pattern and trend analysis

Predictions are NOT:

• ✗Guarantees of future results
• ✗Financial, commercial, or professional advice
• ✗100% accurate information

8.2 Exclusion of Warranties

The Service is provided "as is" and "as available". We do not guarantee absolute prediction accuracy, uninterrupted availability, complete absence of technical errors, or that the Service meets all your expectations.

9.1 Maintenance

We reserve the right to perform scheduled maintenance (with prior notice when possible), implement updates and improvements, and temporarily suspend the Service for technical reasons.

9.2 Modifications

We may modify, suspend, or discontinue any aspect of the Service at any time. In case of discontinuation, unused credits will be proportionally refunded with at least 30 days notice.

10.1 GDPR/LOPDGDD Compliance

• ✓ARCO+ rights exercise guaranteed
• ✓Right to be forgotten implemented

10.2 Account Deletion

You can request complete deletion of your account and all your data at any time from /legal/delete or by contacting soporte-viral@apisdom.com.

11.1 Applicable Legislation

These Terms of Service are governed by Spanish legislation and, in particular, by:

• •Law 34/2002 (LSSI-CE)
• •Regulation (EU) 2016/679 (GDPR)
• •Organic Law 3/2018 (LOPDGDD)
• •Royal Legislative Decree 1/2007 (General Consumer Law)

11.2 Jurisdiction

For any dispute arising from these terms, the parties submit to the Courts and Tribunals of Alicante, Spain.

11.3 Alternative Dispute Resolution
